Treasurer’s Report
- Schwindt found several small errors in the
February financials, nothing major
- It appears (from the bills that were
received) that NWCM has changed insurance carriers without telling us.
- Taxes have been signed by Scott and
delivered to NWCM.
Legal Matters
- Scott spoke to Vial & Fotheringham, our
legal firm, about whether or not the Board has the right to make a rule
banning dogs from two of our parks.
The answer was that the “rules and regulations” the bylaws
authorize us to pass, which are also called “resolutions”, are not
considered to be the same as amending the CC&Rs and do not require a
vote of the homeowners. The
Board can pass these resolutions as long as they are “reasonable”, and our
legal counsel feels that restricting dogs from two of our six parks, one
of which (the Tot Lot) is already off-limits to dogs by City of Hillsboro
ordinance, passes that test.
- Scott (in his role as President) hopes that
this statement from the lawyer will allow us to spend less time on the pet
issue until the Pet Committee has completed their survey and/or has action
items to recommend.
- NWCM has given us incorrect advice on this
issue.
- NWCM has also given us incorrect advice on
the regulation of satellite dishes.
It turns out that the FCC severely restricts the ability of an HOA
to govern satellite dishes, and has for quite some time.
- Scott presented the ARC’s new satellite dish
guidelines to the Board, and made a motion that they be posted on the
website and included in the new homeowner packet, ARC applications and
violation notices. Motion
passed 4 aye, 1 absent.
- A demand letter has been sent to West Hills
about their underfunding of the rowhomes prior to turnover; no response has been received.
Committee Reports
- ARC
- As recorded above, new
satellite dish guidelines have been written and approved
- NWCM has provided the ARC with
a color palette to use when approving applications for new paint
- LSC
- Neighborhood Watch
- There will be a “Night Out”
event on July 30th, in cooperation with the Social committee
- Neighborhood Watch signs are
up. May request another one
for the entrance at 60th and Wetherby, as that entrance is
regularly used by people walking in to the community
- Still looking into solar lights
for mailboxes
- Would like to join up with
other committees to have a barbeque and recruit new members. Block captains are especially
needed.
- NWCM notified the committee
about an increase in thefts of copper ornaments in the community
- Government Affairs
- Social/Newsletter
- A decision has been made to not participate
in the Windemere community calendar (as was discussed at last month’s
meeting)
- Website
- Vasu has created e-mail aliases for all the
committees and he encourages everyone to use those instead of maintaining
their own distribution lists
- Vasu demonstrated the new forums he has set
up on our website (http://www.orencogardenshoa.org/forums)
for the Board and asked us to give him feedback
- Pet
- Letter to Apartment management about pet
waste issue has been signed by Scott and is ready to mail
- Other letters and e-mails, as directed last
month, are in progress
- Committee is working on a proposal for more
pet stations and trash cans throughout the community
Miscellaneous
Business
- Along with the tax forms, Scott also dropped
off the signature cards and an amendment to our filing as a non-profit to
NWCM
- While he was at NWCM, Scott discussed the
various outstanding repair items:
- Ken Verhaalen will do the siding and
shutter paint/repair work
- The Pavilion will be cleaned now, the
gazebo can wait until later in the summer
- NWCM keeps sending bids to have all gutters
cleaned. Scott clarified
again that he wants this work done only in response to homeowner
complaints
- Scott went over his Board Status Report
list. Tasks are
generally getting done on time.
- Scott presented a new financial penalties
resolution, to clarify what steps we will take when a homeowner does not
respond appropriately to a violation notice. Motion to adopt the new resolution passed 4 aye, 1
absent.
Open Forum
- Vasu Srinivasan recommended telling homeowners
to paint their satellite dish to match their home or roof. He asked if our board packs can be
made public (no, because they contain information about violations which
are not public knowledge). He
has scanned the CC&Rs to be put on the website.
- Yvonne DeHart. Lives in a rowhome on Alder. Her gutters are falling off and allowing water to
trickle down, causing mold to grow around the front door. Has reported this to NWCM several
times, including sending pictures.
Cannot get any response.
- Ravivan Tanovan asked Scott a number of
questions about what our lawyer said about the pet ban. They continued their
discussion after the meeting, so that others would have their turn at open
forum.
- Aysegul Jezewski. Wants to know how forums will be used (general
communication among homeowners and committee members). Asked if more budget details are
available, so Scott showed her what he has in his spreadsheets.
- Amy deGuzman thinks the forums are a great
idea.
